The case was discontinued after the first hearing when the client was represented by Eugene McLaughlin (platinum level lawyer). The issues in the case were whether the interview could be used after the police failed to notify the client of the right to speak to a lawyer on the phone. It was also noted that error messages appeared to be displayed on the evidential breath test device which may have required the police to move to blood or urine.
