The client was prosecuted for driving with excess alcohol. The issues in the case were mistakes in procedure as the police had failed to complete the MG DD/A booklet and did not ask questions to eliminate contamination. The prosecution also failed to serve a copy of the breath test printout 7 days before trial as required by the Road Traffic Offenders Act 1988.
