It was successfully argued on appeal by Nicholas Fridd (bronze level lawyer) instructed by Sandra Cooper (reviewing lawyer) that as the client had no intention of driving there were special reasons not to impose a driving ban. The Judge decided not to impose any penalty points and costs were awarded.
