There are several reasons why it is important that you have representation from this firm at the first hearing.
It may be possible to persuade the prosecution to discontinue the charges if evidence is missing.
If the client self-represents and does not set out all the legal arguments properly at the first hearing the Judge may accuse the defence of an ambush at trial and prevent us from presenting the issues that were not raised by the client.
Procedural arguments are complex and it is very important that relevant case law is noted on the PET form (Preparation for Effective Trial).
You may be harshly criticised by the court if you are unable to clarify the legal issues with the court.
You may be subject to bail conditions not to drive if you are unrepresented and are unable to persuade the court there is an arguable case.
We must present to the court a list of video and documentary evidence from the arrest, booking in and specimen procedures in the PET form. The charges may then be dismissed where a fair trial is impossible due to non-disclosure.
Without representation you may come under pressure from the Judge to plead guilty resulting in immediate disqualification.
You will see that the first hearing is not just a simple case of 'getting the case adjourned'.
Like building a house the most important aspect is the foundations. The first hearing is very much the building blocks of the case which must be done the right way if you are to have the best chance of a successful outcome.
